1. Purpose
These Terms of Service govern access to and use of the website www.restauranteaqua.com (the "Website"), as well as the relationships arising from reservations made through it at AQUA Restaurant. Accessing the Website implies full and unconditional acceptance of these Terms.
2. General information
In compliance with Article 10 of Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), the Website is owned by Royal Sun Management S.L., Spanish Tax ID B76592476, with registered address at Calle Geranios, 16, 38683 Los Gigantes, Tenerife, Spain.
3. Conditions of use of the Website
The User undertakes to:
- Use the Website lawfully and appropriately, in accordance with applicable law, morals, and good customs.
- Not use the Website for fraudulent, illegal, or third-party-rights-infringing purposes.
- Not introduce viruses, malware, or any element that may alter the Website's operation.
- Provide truthful, accurate, and up-to-date information when making reservations or sending enquiries.
- Not publish false, offensive, or defamatory reviews on platforms associated with AQUA Restaurant.
4. Reservations
4.1. Reservation process
Reservations can be made via the CoverManager system on the Website, by phone, email, or WhatsApp. A reservation is considered confirmed once the User receives explicit confirmation from the restaurant or the booking system.
4.2. Cancellation and no-show policy
- Cancellations made at least 4 hours before the reservation time are free of charge.
- For groups of more than 8 guests, or reservations on public holidays and special dates, a deposit or guarantee card may be required. Specific conditions will be communicated upon confirmation.
- In the case of no-show on card-guaranteed reservations, a charge equivalent to the minimum menu price per guest may apply.
- The restaurant will hold the reserved table for 15 minutes from the indicated time. After that, the table may be released.
4.3. Changes
Changes to the number of guests, date, or time must be communicated as early as possible. The restaurant will try to accommodate requests subject to availability.
5. Prices and payment
- All prices shown on the menu and Website are in euros (EUR) and include the applicable Canary Islands Indirect General Tax (IGIC).
- Payment is made at the end of service at the establishment, by cash, credit/debit card, or accepted digital methods.
- AQUA Restaurant may modify prices without prior notice. The applicable prices will be those published at the time of reservation or consumption.
6. Intellectual and industrial property
All content on the Website (texts, photos, videos, brand, logo, design, code) is owned by Royal Sun Management S.L. or by third parties who have authorised its use, and is protected by intellectual and industrial property laws. Reproduction, distribution, public communication, or transformation is prohibited without the express written authorisation of the owner, except for uses permitted by law.
7. Reviews and user-generated content
If the User publishes reviews, ratings, or photos on platforms associated with AQUA Restaurant (Google, TripAdvisor, social media), they warrant that such content:
- Reflects a real and truthful experience.
- Does not contain false, libellous, slanderous, offensive, or discriminatory information.
- Does not infringe third-party rights (intellectual property, image, privacy).
AQUA Restaurant reserves the right to request the removal of content that does not meet these requirements and to take any applicable legal action.
8. Liability
- Royal Sun Management S.L. is liable for the quality of service provided at the establishment in accordance with applicable consumer protection law (Spanish Royal Legislative Decree 1/2007).
- The Website may experience technical interruptions for maintenance or external reasons. Continuous availability is not guaranteed.
- The restaurant is not liable for damages arising from misuse of the Website by the User or breach of these Terms.
- The restaurant is not liable for personal items forgotten or lost at the establishment, notwithstanding reasonable efforts to return them to the owner.
9. Allergens and food information
In accordance with EU Regulation 1169/2011, the restaurant provides information on allergens present in each dish upon request. It is the User's responsibility to inform the restaurant of any allergy, intolerance, or dietary restriction when making the reservation or placing the order.
10. External links
The Website may contain links to third-party sites (Google Maps, social networks, review platforms, payment providers). Royal Sun Management S.L. does not control such sites and is not responsible for their content or policies.
11. Data protection
The processing of the User's personal data is governed by the Privacy Policy, which forms an integral part of these Terms.
12. Changes to these Terms
Royal Sun Management S.L. reserves the right to modify these Terms at any time, publishing the updated version on this page. The last update date appears at the top of this document.
13. Governing law and jurisdiction
These Terms are governed by Spanish law. For the resolution of any dispute arising from the use of the Website or the services provided, the parties submit to the Courts of Santa Cruz de Tenerife, expressly waiving any other jurisdiction that may apply, except where consumer law establishes a different mandatory jurisdiction.
